Ceisteanna—Questions. Oral Answers. - Acquisition of Kildare Estates.

asked the Minister for Lands if he will state if the Land Commission have continued proceedings for the acquisition of the Cussen Estate at Killeighter, Kilcock, County Kildare; and how the matter now stands.

A notice under Section 39, Land Act, 1939, was published by the Land Commission in respect of the holding of Michael and Joseph Cussen, containing 371a. 2r. 29p. on the Cloncurry Estate at Killeighter. A petition against resumption, lodged by the tenants, was refused by the Land Commission on 9th February, 1944. Owing to the curtailment of activities, due to emergency conditions, no further action towards resumption has been taken in this case up to the present.

Can the Minister at this stage give any indication as to when the Land Commission propose to resume their activities on a pre-emergency scale?

There are so many different standards of pre-emergency scales, it would be difficult to indicate what the activities of the Land Commission will be in the future, but we do hope in the early future to be near normal.

asked the Minister for Lands if he will state what progress has been made regarding the acquisition of the lands of Miss Elizabeth M. Nolan, comprising 339 acres, in the townlands of Roestown and Gragadder on the Aylmer Estate, Kilcock, County Kildare.

The Land Commission published a notice of intention to apply to the Appeal Tribunal for leave to resume the holding of Elizabeth Mary Nolan and on 20th February, 1941, refused a petition against resumption lodged on behalf of the tenant. Subsequently an application was made to the Appeal Tribunal for an Order authorising the resumption of the holding. This application was adjourned as the tenant instituted High Court proceedings seeking to restrain the Land Commission from prosecuting the appeal any further. Subsequently the High Court proceedings were discontinued and the action struck out. The Land Commission have not been in a position to take further steps towards resumption up to the present.

Can the Minister say when the Land Commission propose to deal with this very large holding, which is in an area where there is a considerable demand for land?

It would be very difficult for me to say.
