asked the Minister for Lands whether he is aware that in connection with repair of river embankments on the Godfrey estate, County Kerry, his Department require the tenants concerned to sign an undertaking that they are responsible for maintaining these embankments, and, further, that the tenants paid the necessary contribution before any query arose as to maintenance, and whether, in the circumstances, he will have the provision referred to waived.

The tenants in question are responsible for the maintenance of the protective works on their holdings and the Land Commission are not empowered to relieve them of this responsibility. Refusal to sign the required undertaking will not lessen the tenants' responsibility to maintain the embankments but will delay the execution of the necessary repair works.
