asked the Minister for Lands if he will state the position at the present time regarding the acquisition of the Algy estate, Together, Hollymount, County Mayo, and whether proceedings have been dropped in the case.

The Land Commission instituted proceedings for the acquisition of the estate in question but an objection to acquisition was upheld in respect of part of the lands. The proceedings in respect of the other part were continued and are well advanced. Meanwhile, with a view to securing possession of the entire estate, the Land Commission are negotiating with the owners for an exchange of holdings and the completion of the acquisition proceedings must await the outcome of these negotiations.

Am I to understand from the Minister that negotiations for an exchange have taken place for portion but not all of the lands in question?

I cannot say, really.

Could the Minister say if the price has been fixed?

The price was fixed by the Appeal Tribunal in October, 1949. The owners had made an application for an exchange in respect of all their land. They were offered an exchange holding but apparently they were not satisfied with it. The position is that the provision of another holding for them is being considered.

Could the Minister say if the exchange that is now proposed is for part or for all of the lands? Has he that information?

I have not the information but I will let the Deputy know.

An appeal against the price fixed by the Land Commission for this estate has been heard by the Appeal Tribunal and judgment is awaited.
