asked the Minister for Local Government if a vested local authority dwelling provided under the Labourers Acts (or the Housing of the Working Classes Acts) can be occupied during the annuity period by a person who is not eligible to obtain the tenancy of the dwelling, but who inherits an interest in the dwelling arising from the will or intestacy of a former tenant; or if such a beneficiary can inherit only a financial interest in the dwelling, which may be sold to a qualified person.

A cottage vested under the Labourers Act, 1936, is held during the payment period subject to statutory conditions including a condition that the cottage will be used during such period for one and one only of the purposes specified in the Act. The Act also provides, however, that the local authority may, with the consent of the Minister, suspend the operation of any of the statutory conditions which restrict the purposes for which a cottage may be used if they are satisfied that full compliance with the conditions would be unreasonable or would cause undue hardship.

In the case of houses being purchased under the Housing of the Working Classes Acts, the answer to the Deputy's Question would depend on the terms on which ownership of the house was transferred by the housing authority to the tenant.
