Mr. Barrett

asked the Minister for Justice if he will make a statement detailing the rights of the members of the Garda to stop and question members of the public proceeding on foot on the public thoroughfare by day or night; and if he will make a statement detailing the rights of members of the Garda to detain or arrest such persons.

The power of the Garda Síochána in relation to matters such as arrest without warrant derive from the Common Law and from numerous statutes dealing with particular classes of offences. It would be beyond the compass of a reply to a Parliamentary Question to attempt to give a comprehensive statement of all the circumstances in which such an arrest is authorised by law.
