Vol. 231 No. 12

Ceisteanna—Questions. Oral Answers. - Holidays of Society Agents.

37.

asked the Minister for Labour if he will state, in view of the adverse Supreme Court decision sustained by the Attorney General in his action against a British-based friendly society for failure to extend holidays with pay under the existing Holiday Act to full time commission agents employed by that society, if he contemplates any action in regard to new or amending legislation to ensure that such workers may be enabled to enjoy holidays with pay in common with workers in all other industrial and commercial employment.

I take it that the Deputy is referring to a recent High Court decision which found that certain agents are not employees within the meaning of the Holidays (Employees) Act, 1961. The position arising from this decision is at present under consideration in my Department.
