asked the Minister for Social Welfare why unemployment assistance was withdrawn from a person (details supplied) in Charleville, County Cork, who had qualified for a number of years.

On 27th November, 1973, the person named made a claim to unemployment benefit which was disallowed by a deciding officer. In addition to his employment as a farm labourer, the insured person is also the beneficial occupier of a farm. Statutory regulations provide that where a person has another occupation, as in this case, from which the remuneration or profit is more than 50p per day, he cannot be paid unemployment benefit unless at least 78 employment contributions have been paid in respect of him in a given period of three years prior to his claim.

In this case investigation by a social welfare officer was considered to be necessary in relation to the claim of 27th November, 1973. This established that the profit from farming was very much in excess of the statutory maximum and the claimant did not satisfy the contribution requirement mentioned in relation to the claim in question.

The claimant appealed against the deciding officer's decision, but the appeals officer, on the evidence before him, disallowed the appeal. An application for unemployment assistance has not been made by the person in question although he was invited to apply on the date he made the claim for unemployment benefit.
