Vol. 298 No. 9

Written Answers. - Drainage Spoil Compensation.

72.

asked the Minister for Finance if the Office of Public Works will pay compensation to two persons (details supplied) in Counties Westmeath and Offaly on whose land all the spoil from a drainage scheme is being deposited because that Office wish to prevent damage to the forestry on the opposite side of the river.

It would be a matter for the landowners themselves to claim compensation if they consider they have suffered loss or damage as a result of the drainage works. They have not done so. A claim must be made within one year from the date of commencement of the interference to which it relates. Any such claim would be considered in accordance with the provisions of the Arterial Drainage Act, 1945. In the assessment of compensation any benefit the claimant may have received from the drainage works would be a matter for regard.
