Vol. 335 No. 5

Written Answers. - Turbary Plots.

379.

asked the Minister for Agriculture if he will clarify the present position of tenants who were allocated turbary plots by the Land Commission but where no development took place for a number of years; and if he will indicate the position which obtains where the land owners concerned object to or prevent such tenants from cutting turf on these plots.

I assume the Deputy is referring to tenants who have been allocated turbary rights on a permanent basis or have been licensed under turbary regulations to exercise such rights.

In either case the position generally is that, unless the Land Commission have clearly intimated that they propose to abandon the rights or cancel the regulations, the rights or licences must be regarded as remaining effective, even if they have not been exercised for a number of years.

If the Deputy has any particular case in mind perhaps he will let me have the particulars and I will ask the Land Commission to look into it.
