Vol. 341 No. 9

Written Answers . - Division of Commonages .

881.

asked the Minister for Agriculture if he will arrange for the Land Commission to divide compulsorily, if necessary, mountain commonages in cases where there is only one objector.

: Where one or more but not all of the owners of a commonage wish to have it divided it is open to them to apply to the Land Commission for compulsory division. Any such applications will be fully investigated.

If the Deputy is aware of any case where some of the owners are objecting to division of a commonage perhaps he would let me have the particulars and I will ask the Land Commission to see whether they can do anything to either achieve an agreed division or assist in preparation of an application for a compulsory partition order.

882.

asked the Minister for Agriculture if he will arrange for the Land Commission to divide compulsorily, if necessary, the commonage at Dromlusk, Blackwater PO, Killarney, County Kerry, between persons (details supplied) in view of the numerous representations made in this case and of the importance of having the commonage divided.

: The application for division of this commonage was made under the Western Package under which the consent of all the co-owners is required. As one of the three owners did not consent, division was not possible under that package.

One or more of the co-owners may, if they wish, apply to the Land Commission to have the commonage divided compulsorily under section 24 (3) of the Land Act, 1939.
