617.

asked the Minister for Social Welfare when unemployment assistance will be paid to a person (details supplied) in County Wexford.

: Following the completion of inquiries, the unemployment assistance claim of the person concerned has been allowed at the maximum rate payable to him, £69.55 weekly.

618.

asked the Minister for Social Welfare when unemployment assistance will be paid to a person (details supplied) in County Wexford.

: The application of the person concerned for unemployment assistance on 17 January 1983 was authorised at the weekly rate of £1.05 being the appropriate maximum rate in her case of £25.45 less means £24.40 derived from the value of board and lodgings on her parents' farm. Following her appeal against the means assessed against her an appeals officer assessed her weekly means at £22 from 17 January 1983. Unemployment assistance was accordingly authorised at the revised weekly rate of £3.45 being the appropriate maximum rate in her case of £25.45 less means £22. All arrears due were issued to her last week and weekly payments of £3.45 will continue to be made as they become due.

619.

asked the Minister for Social Welfare the reason unemployment benefit is not being paid to a person (details supplied) in County Cork.

: The person concerned exhausted his title to unemployment benefit on 18 December 1982 when he received 390 days benefit. He can only requalify when he has a further 13 weeks of insurable employment. He was, however, in receipt of weekly unemployment assistance at the maximum rate payable to him £63.75 until 18 April 1983 after which he ceased to sign as unemployed.

620.

asked the Minister for Social Welfare the reason unemployment assistance is not being paid to a person (details supplied) in County Cork.

: The unemployment assistance claim of the person concerned was disallowed on the grounds that his means derived from self-employment as a cattle dealer exceed the statutory limit. He appealed against the disallowance and his case was referred to a social welfare officer for clarification of a number of points raised by the applicant in support of his appeal. The inquiries have now been completed and the case is being submitted to an appeals officer for determination. His entitlement to unemployment assistance will be reviewed in the light of the decision of the appeals officer.

621.

asked the Minister for Social Welfare the reason disability benefit is not paid to a person (details supplied) in County Cork.

: The person concerned was paid disability benefit from 27 October 1981 to 5 March 1983 after which date payment was disallowed following examination by a medical referee who expressed the opinion that he was capable of work. He appealed against the disallowance and, in connection with his appeal, arrangements have been made to have him examined by a different medical referee on 2 May 1983. His entitlement to further payment of disability benefit will be reviewed in the light of the medical referee's report following this examination.

622.

asked the Minister for Social Welfare the reason unemployment benefit has not been paid to a person (details supplied) in County Cork as he has been signing since May 1982.

: The claim of the person concerned on 30 June 1982 to unemployment benefit was disallowed on the grounds that he did not satisfy the contribution conditions. His employment is insurable at Class J rate which is for occupational injuries benefit only and does not provide entitlement to unemployment benefit.

623.

asked the Minister for Social Welfare if he will reconsider his decision on an application for a widow's pension by a person (details supplied) in County Clare.

: The claim to widow's non-contributory pension of the person concerned was refused as her means, which were assessed at £56.89 per week derived from capital and an intestacy interest in a holding of land, exceeded the statutory limit of £46.00 per week for receipt of pension by a widow under 66 years of age with one qualified child.

The Deputy's question has been accepted as an appeal on her behalf against this decision and a form on which to set out the facts and contentions on which she relies in support of her case has been issued to the widow.

When the completed form is returned the appeal will be submitted to an appeals officer for determination and she will be notified of his decision as soon as it becomes available.

624.

asked the Minister for Social Welfare the present position regarding an application for a deserted wife's allowance by a person (details supplied) in County Laois.

: The claim of the person concerned to deserted wife's allowance/benefit was refused on two counts; firstly that she did not make reasonable efforts to trace her husband's whereabouts and to prevail on him to support her and, secondly, that she is subject to disqualification as long as she and another person are living together as man and wife.

The claimant has indicated that she wishes to appeal against the decision and a form on which to set out the facts and contentions on which she is relying has been forwarded to her. On return of the form, duly completed, her case will be submitted to an appeals officer for determination and she will be notified of his decision as soon as it becomes available.
