asked the Minister for the Environment if he will arrange with Kerry County Council as a matter of extreme urgency to clear or demolish the very bad derelict building at Dungarvan, Ballinskelligs, County Kerry, which is located opposite a licensed premises and in a high tourist and amenity area.

Under the Local Government (Sanitary Services) Act, 1964, it is a matter for the sanitary authority, in this case Kerry County Council, to determine whether any structure in their area is, or is likely to be, dangerous to any person or property and to take any necessary action. Under the Derelict Sites Act, 1961, the county council have additional powers to require works to be undertaken by the owners of derelict sites and, in certain situations, to carry out the works themselves or to acquire a site. In these circumstances, I have brought the Deputy's query to the notice of Kerry County Council and I understand that they are looking into the matter.
