asked the Minister for the Environment if he will indicate under what authority his Department claim the right to withhold a mortgage subsidy to a local authority mortgagee, who has been allocated a low rise mortgage subsidy; and, if such authority exists if such a subsidy can be withheld in lieu of payment of debts to his Department.

The terms of the mortgage subsidy scheme, as introduced with effect from 10 April 1981 and as notified to local authorities by circular letter, specifically provided that no applicant was entitled to obtain both a low rise mortgage subsidy and the new special mortgage subsidy. Legislation to give effect to the terms of the latter scheme including specific provisions to ensure that applicants may not benefit from both subsidies is being prepared at present and will be introduced as soon as practicable.
