I am not empowered under the provisions of the Foreshore Act, 1933 to make special provision in prohibitory orders with respect to any description of persons. However, the making of a prohibitory order does not preclude me from granting to any person under section 3 of the Act a licence to remove beach material from the foreshore. Each application for such a licence is considered on its merits but in such cases an application would normally be approved only on the recommendation of the local authority which applied for the prohibitory order.
