asked the Minister for Labour the position regarding redundancy payment to a person (details supplied) in County Offaly as the last correspondence Deputy Connolly received from his Department was in November 1983.

The employee concerned has claimed a redundancy lump sum from the Redundancy Fund. However, under the provisions of the Redundancy Payments Acts the obligation to pay a redundancy lump sum to a redundant worker rests primarily with the employer by whom the worker was employed. It is only when the employer fails or refuses to pay that the question of payment from the fund arises. The person mentioned in the Deputy's question should, if he has not already done so, apply to his former employer on form RP77 for payment of his lump sum. If the employer refuses to certify the employee's redundancy by giving him a redundancy certificate, the employee may then appeal to the Employment Appeals Tribunal to establish his entitlement. If the employer certifies the redundancy or if the employee's entitlement is decided by the tribunal, and the employer still refuses or fails to pay, the employee should then apply to my Department for payment of his lump sum from the redundancy fund.

I am writing to the Deputy immediately to explain the procedure for claiming a redundancy lump sum in this particular case and supplying the necessary forms.
