asked the Minister for Social Welfare if a person (details supplied in County Wexford or his wife is entitled to a higher rate of unemployment assistance or benefit further to the EC equality directive.

It has not been possible to trace receipt of a claim to unemployment benefit or assistance which refers to the person named in the details supplied.

Further inquiries in the matter will be made if the Deputy will furnish additional information to enable the person concerned to be identified.

asked the Minister for Social Welfare when disability benefit payments will be made to a person (details supplied) in County Wexford.

The person concerned claimed and is in receipt of disability benefit since 15 January 1985. Payment has been issuing on a weekly basis on receipt of medical evidence of incapacity for work and all benefit payable has been issued to 16 March 1987. However, due to an administrative error, and overpayment of £91.12 has occurred. It is proposed to recover this amount by weekly deductions of £5.

Benefit will continue to issue, on receipt of medical evidence of incapacity, at the weekly rate of £84.10. This is comprised of the maximum personal rate of £41.10, plus half the child dependant allowance, amounting to £23. The person concerned is also entitled to the temporary alleviation payment of £20 per week, which will be paid until 16 November 1987 or until the end of his claim, whichever is the sooner.

asked the Minister for Social Welfare if a person (details supplied) in County Wexford will be granted an oral appeal hearing in relation to his disability benefit claim.

The person concerned was paid disability benefit to 14 November 1986 after which date payment was disallowed following examination by a medical referee who expressed the opinion that he was capable of work. He appealed against the disallowance of benefit and was examined by a different medical referee on 15 January 1987 who also expressed the opinion that he was capable of work.

His appeal has been referred to an appeals officer who proposes to hold an oral hearing on his claim as soon as possible.
