asked the Minister for the Environment if his attention has been drawn to the proposed large profits to be gained from the development of Roches Hill, Killiney, County Dublin, arising from an original investment of approximately £40,000 for this amenity; and the action, if any, he will take to prevent this anti-social speculation.

I am aware of the arbitration hearing concerning a compensation claim arising from the refusal of planning permission for housing development at Roches Hill, Killiney. The hearing has been adjourned until 15 May 1987. Dún Laoghaire Corporation are strongly contesting the claim and it is a matter for the property arbitrator to determine the amount of compensation, if any, which may be payable.

I am very conscious of the need for constant vigilance to ensure that the Planning Acts do not provide the opportunity for individuals to make unreasonable gains at the expense of the community. The legislation is being examined in my Department at present with a view to seeing what amendments are desirable and possible. The Deputy will be aware, however, that the whole area of compensation is a very complex one, with major constitutional issues involved, and that a delicate balance must be struck between the rights of the individual and the rights and interests of the community at large.
