asked the Minister for Health if in view of the facts of a case (details supplied) in Dublin 22 he will now agree to the payment of disabled persons's maintenance allowance; and if he will make a statement on the matter.

The amount of disabled persons maintenance allowance payable in any individual case is a matter for determination by the health board concerned having regard to all the relevant circumstances in that case. In determining the amount of allowance payable to an applicant, health boards are obliged to take account of the means of the applicant's spouse, including any payment from the Department of Social Welfare.

I have had inquiries made from the Eastern Health Board in this case. I have been informed that, when account is taken of the means of the applicant's spouse, the person concerned is not considered eligible for the allowance on means grounds.
