asked the Minister for Social Welfare if a decision has been made in the case of a person (details supplied) in Dublin 17 who attended an oral hearing on Wednesday 20 May 1987 regarding having disability benefit discontinued to her; and if he will make a statement on the matter.

The person concerned was in receipt of disability benefit since July 1985. Payment was disallowed from 2 February 1987 following examination by a medical referee who expressed the opinion that she was capable of work.

She appealed against the disallowance and in connection with her appeal she was examined on 6 March 1987 by a different medical referee who also considered her to be capable of work. Her appeal was then referred to an appeals officer for determination.

Following an oral hearing the appeals officer decided that the claimant was incapable of work from 30 January 1987 to 4 May 1987 (the date of the latest medical certificate before him) and is entitled to payment of disability benefit for that period.

Accordingly, the arrears of disability benefit, less the amount of unemployment benefit paid to the person concerned in the interim, will be issued as soon as possible and further payments of disability benefit will continue to be issued as medical evidence is received.
