asked the Minister for Finance the reason for the removal of a boundary fence from the property of a person (details supplied) in County Kerry; if, in the absence of the boundary fence his Department will protect the property concerned and two adjoining properties from trespass and indemnify them in the event of subsequent compensation claims; the reason the person concerned was not notified in writing prior to removal of the boundary fence; and if he will make a statement on the matter.

The fence in question was placed on national park lands which are State property, without the consent of the Commissioners of Public Works. As it blocked the use of a right-of-way along the lake shore it was removed by national park staff in accordance with advice from the Chief State Solicitor. Officials from the Office of Public Works later met the person named in the question and explained the position to him.
In the circumstances there is no question of the commissioners having to indemnify adjoining owners against compensation claims in the event of trespass on such properties.
