Written Answers. - Council of Europe Conventions.

76 Mr. J. Bruton asked the Minister for Foreign Affairs if he will list the conventions sponsored by the Council of Europe which Ireland has (a) signed and ratified (b) signed but not yet ratified and (c) neither signed nor ratified; when the convention was adopted in cases (b) and (c) the reasons Ireland has not yet ratified these conventions.

Since its establishment in 1949 the Council of Europe had adopted a total of 135 Conventions, three of which have been subsumed into more comprehensive Conventions, and 23 of which are not in force because they have not been ratified by the necessary number of countries.

Ireland has signed and ratified a total of 57 of those Conventions. A further 11 have been signed but not yet ratified and 64 Conventions have not been signed. Rather than list the many Conventions by name I would refer the Deputy to the compendium containing a full list of Council of Europe Conventions, together with their date of adoption, which I have arranged to have made available for consultation by Deputies in the Oireachtas Library.

The Conventions which bear the following numbers have been ratified by Ireland: 1, 2, 5, 9, 10, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22, 24, 26, 27, 31, 32, 33, 35, 36, 37, 38, 39, 40, 41, 43, 44, 45, 46, 47, 48, 50, 53, 55, 58, 59, 65, 67, 84, 85, 87, 89, 90, 102, 103, 104, 106, 109, 110, 111, 118, 126, 134. Those numbered as follows have been signed but not ratified by Ireland: 23, 34, 72, 78, 101, 105, 108, 112, 117, 120, 121. The following Conventions have not been signed by Ireland, of which those bearing an asterisk are not in force: 25, 28, 29, 30, 42, 48A, 49, 51, 52, 54, 56*, 57*, 60*, 61*, 61A*, 61B*, 62, 63, 64, 66, 68, 69, 70, 71*, 73, 74, 75*, 76, 77, 79*, 80, 81, 82*, 83, 86, 88, 91*, 92, 93, 94, 95, 96, 97, 98, 99, 100, 107, 113, 114, 115, 116, 119*, 122, 123*, 124*, 125*, 127*, 128*, 129*, 130*, 131*, 132*, 133*, 135*.

Many of the Conventions referred to would require domestic legislation in order to enable Ireland to ratify, and some raise complex legal questions. In the case of others, the question of ratification or signature is currently under consideration. It would not be feasible however to give within the scope of a single reply details of why Ireland has not ratified or signed in every case. If the Deputy wishes to put down a question in relation to any specific Convention, this will be dealt with by me or by the Minister with responsibility for the area which the Convention covers.
