Written Answers. - Social Welfare Benefits.

114 Mr. J. Mitchell asked the Minister for Social Welfare the present position concerning the disability benefit case of a person (details supplied) in Dublin 15; when an appeal will be heard; if, in the interim, payments of disability benefit will continue; if the appeal is upheld, if arrears will be paid to the date on which disability benefit was discontinued; and if he will make a statement on the matter.

Payment of benefit to the person concerned was disallowed from 2 October 1989 following an examination by a medical referee who considered him to be capable of work. He expressed dissatisfaction with this decision and was examined again on 3 November 1989 by a different medical referee, who also expressed the opinion that he was capable of work.

He appealed the decision and his case was referred to an appeals officer for determination. Following an examination of the information available in the case an appeals officer decided to hold an oral hearing to allow the person concerned an opportunity of presenting his case personally. No date for the hearing has been set yet but the person concerned will be advised of the time and place as soon as arrangements are completed.

If the appeal is successful arrears of benefit will be paid from the date of disallowance. In the interim, the person concerned is being paid unemployment assistance.
