Written Answers. - Licence Endorsement.

Ceist:

60 Mr. Davern asked the Minister for the Environment the reason an endorsement given to a person (details supplied) in County Tipperary for one month dated 27 September 1985 is still being recorded on his licence; and if a further endorsement on his licence dated 10 May 1989 which has been removed by the High Court on 11 July 1990 will be removed.

Section 37 of the Road Traffic Act, 1961 provides for the carry over of endorsements to subsequent driving licences, subject to a limit of three years in the case of continuous licences or an aggregate of five years where a period elapses between the date of expiry of one licence and the date of issue of the next licence.

I understand that this person has had four convictions under the Road Traffic Acts since 1985 of which three were quashed on appeal. His licence was endorsed on 17 January 1986 as a result of the fourth conviction. As he has not held continuous licences since, the five year rule applies and this means that he cannot get a licence free of endorsement until 26 January 1991.
