Ceist:

143 Mr. Kenneally asked the Minister for the Environment the reason a person (details supplied) in County Waterford still has an endorsement on his licence despite the fact that it was only endorsed for three years in Cappoquin District Court on 13 June 1986; and if he will make a statement on the matter.

Section 37 of the Road Traffic Act, 1961 provides for the carryover of endorsements to subsequent driving licences, subject to a limit of three years in the case of continuous licences or an aggregate of five years where a period elapses between the date of expiry of one licence and the date of issue of the next licence.

I understand that the licence held by the person in question at the time of endorsement expired on 24 January 1988 and that he did not renew his licence until 3 June 1988. In the circumstances the five year rule must apply to him. He may obtain a licence free from endorsement on 3 June 1991.
