Ceist:96 Mrs. Fennell asked the Minister for Labour if he will indicate the pension position of those persons working in FÁS who originally worked in AnCO.

The pension position of members of the staff of FÁS who were transferred to FÁS as former members of the staff of AnCO in accordance with section 7 of the Labour Services Act, 1987, is provided for under section 8 of that Act.
Prior to the establishment of FÁS, members of the staff of AnCO had negotiated certain superannuation benefits which were not consistent with public service norms and did not have the necessary statutory approval of the Minister for Finance and the Minister for Labour.
On foot of discussions which I initiated between officials of my Department, the Department of Finance and FÁS, agreement has been reached with the union representing former AnCO staff on a resolution to most of these outstanding superannuation issues. Only one issue remains unresolved and it has been decided by FÁS to seek the services of an industrial relations officer of the Labour Court with a view to finalising this matter.
