109 Mr. Nealon asked the Minister for the Marine if he will outline the conditions which are attached to the licence for a sea fishing boat or a tank boat in relation to the places in which they cannot engage in fishing of any sort.

110 Mr. Nealon asked the Minister for the Marine if the licence of a sea fishing boat or tank boat, allows fishing of any sort within a distance of three nautical miles from the baselines.

I propose to take Questions Nos. 109 and 110 together.

In accordance with section 222B (5) (a) — as inserted by the Fisheries (Amendment) Act, 1983 — of the Fisheries (Consolidation) Act, 1959, the Minister for the Marine may attach to a licence granted for the purposes of this section such terms and conditions as he shall think fit and he may also attach further conditions to or vary the conditions already attached to such licence or remove any condition. As Minister for the Marine I attach conditions to licences prohibiting fishing for certain species and in certain places, sometimes within three miles of the baselines, whenever I consider these to be appropriate.

111 Mr. Nealon asked the Minister for the Marine the definition of a sea fishing boat or tank boat, as used for licensing purposes.

For the purposes of licensing of sea fishing boats under the Fisheries Acts, 1959 to 1983, the definition of a sea fishing boat is set out in Part IV of the Merchant Shipping Act, 1894. Under that Act the expression "fishing boat" means a vessel of whatever size, and in whatever way propelled, which is for the time being employed in sea fishing or in the sea fishing service, but save as otherwise expressly provided, that expression shall not include a vessel used for catching fish otherwise than for profit.

It is also relevant to state that the Fisheries (Amendment) Act, 1983, empowers the Minister, by regulations, to exempt, subsequent to registration, certain boats from the licensing requirements. The Licensing of Sea Fishing Boats (Exemption) Regulations, 1983, provides that boats under 65 feet, being already registerd, do not require a licence. Boats over 65 feet or boats in respect of which an application to register is being made for the first time require licences.
