Written Answers. - Employment Equality Cases.

Ceist:

138 Mr. D. Ahern asked the Minister for Labour the number of cases, under section 26 of the Employment Equality Act, 1977, which have been referred to the Director of Public Prosecutions by reason of the refusal of the employers to pay the award made in each such case; the number of prosecutions which have been taken in this regard; and if he will make a statement on the matter.

The referral of cases to the Director of Public Prosecutions' Office under section 26 of the Employment Equality Act, 1977, is a matter for the complainant, the Garda and the Director of Public Prosecutions.

The Minister for Labour can however refer cases of non-compliance with Labour Court Orders to the Chief State Solicitor's Office. Three such cases have been referred to date. Two of these were successfully prosecuted and the other is being pursued at present. The Minister was advised that it was not possible to proceed with a further case as the company was in receivership at the time of the making of the Labour Court order.
