38 Mrs. Owen asked the Minister for Finance whether he has any proposals to amend the Valuation Act, 1986; and if he will make a statement on the matter.

39 Mrs. Owen asked the Minister for Finance whether the Commissioner for Valuations is seeking changes to the Valuation Act, 1852, by way of (1) amendments or (2) new legislation.

I propose to take Questions Nos. 38 and 39 together.

The legislation governing valuation for rating purposes consists of the core legislation passed in the 19th century and two modern statutes of 1986 and 1988. Apart from the changes brought about by these two recent Acts, the law governing the valuation system remains essentially as it was laid down in the Valuation (Ireland) Act, 1852.

It is against this background that I have asked the Commissioner of Valuation, in consultation with the Department of the Environment and my Department, to review the entire valuation code. I expect to have the commissioner's report in mid-year and when I have examined it I will decide on whatever legislative or other measures are considered necessary.
