Written Answers. - County Wexford Foreshore Licence.

64 Mr. Howlin asked the Minister for the Marine if he has granted a foreshore licence in connection with the proposed fish farm at Ballyhealy, Kilmore, County Wexford; and if so, if he will outline (1) the effective date of the licence, (2) the party to whom the licence has been issued, (3) whether these are precisely the same interests as those to whom the planning permission and effluent licence for this project have been granted, (4) whether the licence has been fully signed, sealed and witnessed on the Minister's behalf and on behalf of the other party and (5) whether the party to whom the licence has been granted have undertaken to comply fully with all the conditions of the licence.

I would refer the Deputy to my reply on 24 April 1991 to a question from him about this project. In relation to the items Nos. (1) to (5), I would comment: (1) 9 April 1991; (2) Mr. Frank Kruhoffer; (3) Yes; (4) Yes; and (5) Yes.

65 Mr. Howlin asked the Minister for the Marine the reason three different versions of the foreshore licence for the proposed fish farm at Ballyhealy, Kilmore, County Wexford were issued by his Department to persons who sought copies of this document.

There is only one foreshore licence for this project and copies of that licence, dated 9 April 1991, have been supplied to interested parties. Information supplied prior to that date related to drafts of that licence.

66 Mr. Howlin asked the Minister for the Marine if his attention has been drawn to the fact that the drawing issued by his Department to persons inquiring about the foreshore licence for the proposed fish farm at Ballyhealy, Kilmore, County Wexford delineates a project which differs very substantially from that for which planning permission and an effluent licence have been granted by the planning authority; and the way in which he proposes to have these instruments brought into line with each other.

67 Mr. Howlin asked the Minister for the Marine if his attention has been drawn to the fact that the drawing issued by his Department to persons inquiring about the foreshore licence for the proposed fish farm at Ballyhealy, Kilmore, County Wexford would permit the inlet pipe and the effluent pipe to be located in the very centre of the bathing area contrary to the provisions of the planning permission and effluent licence granted by the planning authority.

I propose to take Questions Nos. 66 and 67 together.

The consistency of the technical drawings associated with the foreshore licence with the local authority planning permissions is being investigated in consultation with the local authority and the licensee with a view to taking any measures which may be necessary to ensure that any works undertaken on the State foreshore are fully consistent with the planning permissions.

68 Mr. Howlin asked the Minister for the Marine if the specification for the diffusers required in connection with the foreshore licence for the proposed fish farm at Ballyhealy, Kilmore, County Wexford has yet been established by the planning authority; and if not, if he will outline the way in which it is proposed to identify and enforce clear-cut binding provisions in respect of these diffusers so far as any planning permission, effluent licence or foreshore licence is concerned.

Matters in relation to the planning permission and effluent licence are the responsibility of the local authority. As regards the foreshore, the diffuser arrangements to apply must conform with the terms of the foreshore licence issued under the terms of the Foreshore Act, 1933.

69 Mr. Howlin asked the Minister for the Marine if, in respect of the foreshore licence for the proposed fish farm at Ballyhealy, Kilmore, County Wexford, he will provide complete copies to the local residents including copies of any plans, drawings and specifications which may be referred to therein so as to enable these residents to establish, with a view to subsequent monitoring, the exact nature of the work to be carried out and also to ensure that the work permitted by the foreshore licence does not contravene the requirements undertaken by the promoter and imposed on him by virtue of the proceedings relating to the planning permission and effluent licence.

Copies of the licence in question have already been made available to the local interests, and others, who have requested them. My Department have indicated, in addition, that copies of the plans, drawings etc., referred to can be made available for inspection at the Department's offices, if desired.
