Written Answers. - Implementation of EC Directives.

Ceist:

18 Proinsias De Rossa asked the Minister for Industry and Commerce if he will list the EC Directives or regulations for which his Department have responsibility, which have not been brought into effect in this country; whether any time-table has been set for the implementation of such regulations; and if he will make a statement on the matter.

I am circulating a list of EC measures under my Department's responsibility in respect of which implementation dates have been reached but which have not yet been transposed into Irish law.

There are various technical reasons for the non-implementation of these measures, ranging from discussions with the EC Commission on appropriate methods of implementation to ongoing drafting work within my Department.

In all cases, however, implementation is under active consideration and it is my intention that all these measures will be implemented as soon as possible.

List, for circulation, referred to in reply to parliamentary question tabled by Deputy De Rossa, Tuesday, 9 July 1991.

EC measures, under the responsibility of the Department of Industry and Commerce, for which the dates for implementation have been reached but which have not, as yet, been transposed into Irish law:

1. Council Directive 90/396/EEC on the approximation of the laws of the member states relating to appliances burning gaseous fuels.

2. Council Directive 82/711/EEC laying down the basic rules necessary for testing migration of the constituents of plastic materials and articles intended to some into contact with foodstuffs.
3. Council Directive 85/572/EEC laying down the list of simulants to be used for testing migration of constituents of plastic materials and articles intended to come into contact with foodstuffs.
4. Commission Directive 90/128/EEC relating to plastic materials and articles intended to come into contact with foodstuffs.
5. Council Directive 89/109/EEC relating to materials and articles intended to come into contact with foodstuffs.
6. Council Directive 88/314/EEC on the indication of prices of non-foodstuffs.
7. Council Directive 88/315/EEC on the indication of prices of foodstuffs.
8. Council Directive 85/374/EEC on product liability.
9. Council Directive on food labelling.
10. Council Directive 89/396/EEC on lot marking.
11. Seventh Council Directive 83/349/EEC based on Article 54 (3) (g) of the Treaty on consolidated accounts.
12. Council Directive 89/298/EEC co-ordinating the requirements for the drawing up, scrutiny and distribution of the prospectus to be published when transferable securities are offered to the public.
13. Council Directive 90/211/EEC amending Directive 80/390/EEC in respect of the mutual recognition of public prospectuses as stock exchange listing particulars.
14. Council Directive 87/344/EEC relating to legal expenses insurance.
15. Council Directive 87/357/EEC concerning products which, appearing to be other than they are, endanger the health or safety of consumers.
