Written Answers. - Amendment of Social Security Legislation.

Ceist:

48 Proinsias De Rossa asked the Minister for Social Welfare if he intends to amend legislation concerning payment of social security benefits outside Irish jurisdiction to make it clear that they do not apply in the case of persons covered by EC regulations; and if he will make a statement on the matter.

The question raised by the Deputy is one which has been raised by the Free Legal Advice Centres (FLAC) in a recent report published by them on the implementation of the EC social security regulations in Ireland. This report is at present being studied within my Department and the question raised by the Deputy, along with other issues raised within the report, will be studied in consultation with legal advice.

The question as to whether an amendment of social welfare legislation on the lines suggested is necessary is under consideration by my Department. Any necessary changes will be provided for us in a forthcoming Social Welfare Bill.
