Vol. 417 No. 5

Written Answers. - Occupiers' Liability.

Jim O'Keeffe

Ceist:

159 Mr. J. O'Keeffe asked the Minister for Justice if he proposes to introduce changes in the law relating to liability of owners and occupiers to those visiting or trespassing on their farms, houses or other property.

The area of the law concerned here is occupiers' liability. It is complex and involves a wide range of interests. These interests may be divided into two broad categories: the many types of occupier, including farmers, householders, tenants, State authorities, even the State itself, and the different legal classes of entrant, invitees, licencees and trespassers. Given the complexity of the law, the many different interests involved and the fact that the law is currently in a state of transition, the matter of possible legal changes is an ideal one for examination by the Law Reform Commission. I understand that the Attorney General has formally requested the President of the Commission to undertake that task.

As soon as the commission complete their work, the question of any possible amendment of the law will be addressed.
