Ceist:

136 Mr. N. Ahern asked the Minister for the Environment if he will amend the Road Vehicles Registration and Licensing (No. 2) Regulations, 1992, to give local authorities discretion to deal with cases in which a certificate of rateable valuation or planning permission for premises is lacking as this requirement is causing hardship such as in the case of a person (details supplied).

I have no plans at present to amend the Road Vehicles (Registration and Licensing) (Amendment) (No. 2) Regulations, 1992, in this respect. I am advised that Dublin Corporation is awaiting receipt of further information before making a final decision in the case referred to. In the event of the application being refused, the person concerned has a legal right to appeal to the District Court.
