Vol. 428 No. 5

Written Answers. - Business Tenancies.

Jim O'Keeffe

Ceist:

97 Mr. J. O'Keeffe asked the Minister for Justice her views on whether the present provision in the Landlord and Tenant Acts, that tenants of business premises are automatically entitled to renewal of any lease over three years, is causing major hardship for tenants trying to start a business who now normally cannot secure a lease of more than two years and 11 months and who then have to move location; and whether enterprise would be best encouraged and the interests of both landlords and tenants would be best served by extending the term to seven years.

In line with a commitment in the Programme for a Partnership Government 1993-1997 a Bill is being prepared in my Department to amend the law on business tenancies. The details will be announced in the ordinary way in due course. However, I can say that the matter mentioned is being examined in the context of preparation of the Bill.
