Ceist:

99 Mr. G. Mitchell asked the Minister for Justice if she will make a statement on the release of a person (details supplied) in County Wexford; whether normal procedures were followed prior to the release; and if the person concerned kept the conditions of his release.

In keeping with long standing practice in these matters I do not propose to comment in detail on the case of this prisoner.

I can confirm, as the Deputy requests, that normal procedures were followed and I can say also that the offender is now back in custody.

Ceist:

100 Mr. Lawlor asked the Minister for Justice if, in view of disturbances in Dublin over the last Christmas holiday period, she will review the policy of Christmas prisoner releases as a number of those released in 1992 were subsequently involved in joyriding as well as other lawbreaking activities; and if she will make a statement on the matter.

The granting of temporary releases to prisoners is a part of prisons administration in every civilised country and most countries in the Christian tradition have an extensive programme of prisoner releases at Christmas.

I am not satisfied that I would be justified in departing from that practice. However, I wish to assure the House that in reviewing cases for consideration for temporary Christmas release, very careful consideration will be given to the likelihood of the prisoner becoming involved in breaches of the law over the period of liberty.
