106 Mr. O'Leary asked the Minister for Agriculture, Food and Forestry the meaning of joint enterprise within the context of applicants for payment of cattle headage and premium grants. [1632/94]

When two or more farmers are co-operating so closely in the management of their herds and holdings that they cannot be deemed to have separate herds and holdings they are regarded as having a joint enterprise for the purpose of the Cattle Headage and Premium Schemes.

Typical factors to be taken into account when assessing whether or not two or more farmers are operating a joint enterprise are as follows: Joint ownership of land, Joint day-to-day management of herds, Mixing or intermixing of herds on one or more holdings, Sharing of grazings or of feed or of feeding facilities or of housing, Sharing the use of machinery, Use of one farmer's facilities by the other(s), Joint bank accounts or income tax returns or purchases of stock or inputs.
