Written Answers. - Athlone (Westmeath) Swimming Pool.

138 Mr. McGrath asked the Minister for Education when an allocation of national lottery funds for a swimming pool in Athlone, County Westmeath, was announced; the amount of the allocation; the instructions issued to the local authority concerning this proposed project; if a contract existed with any person or company for the design of this project; if so, with whom; the reason for the delay in proceeding with this project; and if she will make a statement on the matter. In May, 1993 my Department confirmed to Westmeath County Council that the grant of £1.5 million, which had been originally allocated in 1988 for a multi purpose indoor sports complex, was available for the provision of a new swimming pool in Athlone.

This grant was allocated under my Department's major sports facilities programme and the terms and conditions, which apply to all such Exchequer funded capital projects, were notified to Westmeath County Council. These conditions included requirements in respect of the appointment of consultants, tendering, contract arrangements, management and operation of the completed facility.

Proposals for the appointment of a design team were submitted by Athlone UDC, as client for the swimming pool project, in September 1993. These proposals, taken in conjunction with another design team proposal submitted by Westmeath County Council for the original project, raised a number of complex legal issues, including the question as to whether a contract existed for the design of the project.

Legal advice on these issues, which was received by my Department in June 1994 has been the subject of correspondence and meetings between my Department, Westmeath County Council and Athlone UDC. It is expected that the question of my Department sanctioning the appointment of a particular design team for this project will be finalised shortly. As the legal issues involved in this matter are not yet finalised it would not be appropriate at this stage to indicate the design teams involved.
