Ceist:

78 Mr. E. Byrne asked the Minister for Justice if she will review the case of an application for a licence to drive a small public service vehicle which has been rejected on the grounds that the Garda commissioner has invoked section 11C of Statutory Instrument 111 of 1977; the purpose of this section; and if she will make a statement on the matter. [5706/95]

The regulations referred to by the Deputy, which are the responsibility of the Minister for the Environment, provide, inter alia, that the commissioner of the Garda Síochána shall grant licences to drive small public service vehicles. Furthermore, the regulations provide that the commissioner shall do so if he is satisfied that the applicant for a licence “is not engaged in any occupation which, in the opinion of the Commissioner, is likely to impair his efficiency or to conflict with his responsibilities or to be incompatible with his employment as a driver of small public service vehicles”.

I understand from the Garda authorities that the person in question had his application refused by them following interview, and that he was so informed on 16 February 1995 and of the reason why.
