Vol. 452 No. 3

Written Answers. - Discharge from Permanent Defence Force.

Eric J. Byrne

Ceist:

161 Mr. E. Byrne asked the Minister for Defence the present position regarding the application of a person (details supplied) in Dublin 12 awaiting a discharge on medical grounds. [7855/95]

The position is that the individual in question was discharged from the Permanent Defence Force at his own request "on pension after 21 years service" with effect from 26 January 1972. Prior to his discharge he was examined by a Medical Board and found not to possess the medical standard required for service in the Defence Forces. However, in view of his earlier application to be discharged "on pension after 21 years service" it was decided to proceed with his discharge on that basis. In that regard the pension and gratuity which he received when he left the Defence Forces would not have been increased had he been discharged on medical grounds. In addition to a service pension he is also in receipt of a disability pension under the Army Pensions Acts.

The individual in question has been advised on a number of occasions that if he wishes to have his discharge papers (LA89) amended to show that he was below army medical standards at the time of his discharge from the Defence Forces he should return them to Enlisted Personnel Section. Defence Forces Headquarters, Parkgate, Dublin 8. If he returns the Discharge Papers they will be amended accordingly.
