Vol. 453 No. 2

Written Answers. - Motor Vehicles' Sale and Repair.

Noel Ahern

Ceist:

113 Mr. N. Ahern asked the Minister for Enterprise and Employment the regulations, if any, made by his Department which prohibit the practice of selling and advertising for sale of taxed and untaxed cars and the repair on the public roadway on a commercial basis of vehicles; the plans, if any, he has to introduce such legislation; and if he will make a statement on the matter. [9163/95]

The sale of motor vehicles on a public roadway is subject to regulation under the Casual Trading Act, 1980, which is currently being amended. The Sale of Goods and Supply of Services Act, 1980, provides consumers with protection in relation to the sale and repair of motor vehicles. Goods must be of merchantable quality and the supplier of a service must have the necessary skill to provide that service.

Legislative controls in relation to the advertising of goods, including motor vehicles, are contained in the Consumer Information Act, 1978, and the Misleading Advertising Regulations, 1988.

I have no function in the area of motor taxation.
