Written Answers. - Social Welfare Benefit.

164 Mr. Bree asked the Minister for Social Welfare the reason for the delay in deciding the appeal of a person (details supplied) in County Louth. [11128/95]

The person concerned was in receipt of disability benefit up to 9 June 1994. Her claim was disallowed from that date when, following a medical examination by a medical referee of the Department of Social Welfare, she was deemed to be capable of work. She appealed the decision and she was examined by a different medical referee who also deemed her to be capable of work. Her case was considered by an appeals officer at an oral hearing on 23 January 1995.

As a result of his consideration of the medical evidence following the oral hearing the appeals officer requested that the person concerned be referred for an independent specialist examination. When this examination has taken place and the medical report is furnished the appeals officer will consider the matter further.

The person concerned claimed unemployment benefit from 9 June 1994 to 19 January 1995, when she took up employment. She claimed unemployment benefit again from 6 March 1995 to 26 May 1995 and is currently in receipt of unemployment assistance.
