121 Mr. Ring asked the Minister for Justice if she will expedite registration of lands in the Land Registry in a case (details supplied) in County Mayo in view of the fact that the owner of the land is undergoing severe hardship as a result of the delay in registering of this case which has been ongoing since January 1993. [13850/95]

I am informed by the Registrar of Titles that the registration referred to by the Deputy involves property vested on foot of two Land Commission schedules. The schedules in question were lodged in the Land Registry in 1989. In the case of such schedules, the property is deemed to be registered as of date of vesting by the Land Commission. Registration of these schedules in the Land Registry is thus, of necessity, afforded a lower priority than the registration of dealings. Where a specific need arises which requires that registration of a schedule be completed, e.g. where a further transaction affecting the property in question arises, then the Land Registry endeavour, as far as possible, to expedite such cases.

In view of the circumstances of urgency outlined by the Deputy, I have asked the Registrar of Titles to expedite this case and I understand the Land Commission has already been contacted to secure the provision of the estate map which is necessary to enable the dealing to proceed.
Once registration of the registered owner's title is concluded, the Land Registry will be in a position to process any application for transfer of ownership of the land in Folio 41235 County Mayo to any other party. I should mention, however, that there is no record in the Land Registry of any application for transfer of such ownership from the registered owner to the other person named by the Deputy.
