Ceist:

33 Mr. B. O'Keeffe asked the Minister for Health if he will confirm that £21,399,000 is outstanding in respect of road traffic accident cases where compensation claims have been lodged under the Health (Amendment) Act, 1986; and if he intends to streamline the process by introducing amending legislation. Limerick East): As at 31 December 1994 the total amount outstanding in respect of health board road traffic accident income was £21,397,249. This figure overstates the position as it includes cases which on examination will be shown not to meet the criteria of the Health (Amendment) Act, 1986, relating to liability for charges in the case of road traffic accidents.

The question of a possible amendment of the provisions of this Act in relation to road traffic accident income will be considered when the outcome of a test case due to be heard shortly by the Supreme Court is to hand.
