Michael Creed

Ceist:

193 Mr. Creed asked the Minister for Agriculture, Food and Forestry whether a person (details supplied) in County Cork has applied to the Milk Quota Tribunal for additional milk quota; if so, the current position regarding this application; and when it is likely to be dealt with by the Tribunal. [2861/96]

There is no record in my Department of an application by the person named for additional milk quota. Special forms are available for applications on grounds of hardship, to the milk quota appeals tribunal. I have arranged for a form to be issued in this case.

194 Mr. Creed asked the Minister for Agriculture, Food and Forestry whether a person (details supplied) in County Cork has applied to the Milk Quota Tribunal for additional milk quota; if so, the current position regarding this application; and when it is likely to be dealt with by the Tribunal. An application by the person named for additional milk quota was considered by the milk quota appeals tribunal. The tribunal did not recommend a quota allocation in this case.

Ned O'Keeffe

195 Mr. E. O'Keeffe asked the Minister for Agriculture, Food and Forestry the number of dairy purchasers who have produced milk in breach of EU milk quota regulations; the names of the agents/farmers; the total gallonage for the years since the quota was introduced; and his views on the current position on the various press reports now being published on the way in which payment was made and levies not collected. [2863/96]

The milk quota system is governed by EU and national regulations and its application is strictly enforced by my Department. While it is true that milk was produced in the past in excess of quota, superlevy was incurred and duly passed on to the EU Commission. Should any breach of the milk quota rules come to light as a result of the controls conducted by my Department or be brought to my attention in the context of the Revenue Commissioners' tax audits within the dairy sector, it will be dealt with in accordance with the law governing the milk quota regime.

196 Mr. E. O'Keeffe asked the Minister for Agriculture, Food and Forestry the percentage of milk that will be allocated to young farmer entrants in each of the years 1995 and 1996; and the percentage of additional quota that they will qualify for; the number who have made application; and if he will make a statement on the matter. [2864/96]

The number of new entrants who acquired milk quota and the quantity allocated under milk quota restructuring schemes operated in 1994/95 and 1995/96 was as follows:

The number of total applicants for new entrant's quota under the 1994/95 restructuring scheme was 91. Information on the number of total applicants for the current year's scheme is not yet available.

Ned O'Keeffe

197 Mr. E. O'Keeffe asked the Minister for Agriculture, Food and Forestry if he will request the European Commission to approve of the transfer of flexi milk of 20 million gallons from other EU countries to Ireland to alleviate the hardship being imposed on over-quota producers in this country. [2865/96]

The milk quota regime is operated on the basis of European Council legislation under which each member state is allocated a specific national quota. This legislation makes no provision for the transfer of quota from one member state to another.
