207 Cecilia Keaveney asked the Minister for Enterprise and Employment the steps, if any, currently being taken to ensure equal pay for equal work for cross-Border workers; and if he will make a statement on the matter. [20388/96]

In general, conditions of employment, including rates of pay for the vast majority of employees throughout Ireland, are not regulated by law but are determined through free collective bargaining i.e. by negotiation and agreement between employers and their employees or a trade union acting on their behalf.

An EU Directive on the Posting of Workers has been adopted recently which will oblige employers in any member state of the EU who post workers to another member state to apply the labour legislation and terms and conditions of employment — including minimum rates of pay and overtime — of the host country to those workers. The Directive is required to be implemented by member states by September 1999.
