97 Mr. Briscoe asked the Minister for Education the cost to date and the likely final cost of all legal proceedings relating to the O'Donoghue special education case. [11664/97]

The cost payable by the State in respect of the High Court hearing in the case Paul O'Donoghue-v-the Ministers for Education and Health, Ireland and the Attorney General amounted to £243,951.91. I am not in a position to quantify the cost incurred in respect of the Supreme Court appeal. These are at present a matter for negotiation between the Chief State Solicitor and solicitors representing Paul O'Donoghue. In default of agreement on an appropriate level of costs, this matter will be referred for taxation by the High Court.
