Under the ewe premium scheme the number of ewes on which payment can be made is limited to the number of eligible sheep found in the applicant's flock or the number of quota rights held by the applicant, whichever is the lower. Although the person in question had 197 eligible ewes under the 1996 scheme he had a quota for 50 only and consequently payment was limited to 50 ewes.
Under the 1996 sheep headage scheme the person named applied on 200 mountain breeding ewes but as these ewes were not substantially maintained on mountain grazings he was deemed ineligible for payment in accordance with the terms and conditions of the scheme.
