Ceist:

140 Ms Fitzgerald asked the Minister for Defence the number of cases settled both in and out of court since the Green Book legislation was passed. [26991/98]

The Green Book was published on 9 April last, following which the Civil Liability (Assessment of Hearing Injury) Act, 1998 was enacted on 11 May 1998. From that date until 30 November 1998 a total of 473 cases were settled out of court while a total of 40 cases were dealt with by the courts. The total cost to date of these cases is £11 million. This figure is exclusive of legal costs which in the majority of these cases have not yet been settled.
