Written Answers. - Light Rail Project.

67 Mr. Gregory asked the Minister for Public Enterprise the implications for the residents of Arran Quay Terrace arising from her decision in relation to the Luas light rail route; when the residents will be contacted in this regard; the timescale involved; and if she will make a statement on the matter. [4665/99]

I have approved the application by CIE for a light railway order and in doing so I accepted the conditions recommended by the inspector who held the public inquiry. The light railway order is now being amended to reflect my decision and I expect to be in a position to sign it formally shortly.

The conditions include a requirement that, prior to the commencement of the demolition or occupation of any of the properties at numbers 1, 2, 3, 4, 6, or 7 Arran Quay Terrace, CIE must submit a detailed scheme to me showing its proposals for the redevelopment of Arran Quay Terrace. These proposals are to include, inter alia, the outcome of any application for planning permission made in respect of the proposed reconstruction; details of any agreements with the residents of the terrace and details of the relocation of such residents within the area, if desired by the residents. No action in respect of the occupation of these properties or their demolition will take place prior to my approval of the foregoing plan or any amendment thereto which I may request. Furthermore, prior to the demolition of any property on the Arran Quay Terrace site, CIE is to submit to Dublin Corporation proposals relating to the protection of the amenities of the houses backing onto Arran Quay Terrace at Coke Lane with a view to concluding an agreement with Dublin Corporation. In default of agreement between CIE and Dublin Corporation this matter will be determined by me.

When the inspector's report was received, copies were sent at my request to each of the residents in Arran Quay Terrace. There has not, I understand, been any formal contact since then between CIE and Arran Quay Terrace residents. This is understandable pending signature of the order. However once the order is signed CIE will be in touch directly with the residents. There is in any event a legal obligation on the company to serve documents without delay on every owner of land referred to in the order.
