220 Mr. Allen asked the Minister for Defence if a situation in relation to termination of service in the Naval Service by a person (details supplied) in County Cork will be investigated; and if he will make a statement on the matter. [5186/99]

On 18 January 1999 the individual in question informed the Naval Service of his intention to leave the service and sought clarification as to the procedure in this regard. The person concerned was advised of the administrative procedure and that any application to the Minister for permission to resign would take approximately one month to process. In accordance with section 49 (1) of the Defence Act, 1954, an application for the resignation of a commission must be submitted to the President for approval.

The required administrative procedures in this case were initiated in the Naval Base on 21 January 1999 and the case was submitted to Defence Force Headquarters on 26 January 1999 for processing. It is anticipated that the case will be submitted to the President shortly.
